Four things that decide a Queensland CTP claim

Most people ring us because something has already gone wrong, or because a deadline is close. These are the four points that matter most, in the order they matter.

Tell us a little about your accident.

A Queensland compensation lawyer reads every enquiry. No cost, no obligation, and nothing you tell us leaves the firm.

Who you actually get

Two directors, both named, both on the file

The other car accident sites in this market do not show you a single face. Ours are the same lawyers who run WT Compensation Lawyers, and you can check both of them on the Queensland Law Society roll before you ring.

Tell us what happened. We will tell you if you have a claim.

You will speak to a compensation lawyer, not an intake script. In one conversation we can usually tell you whether a claim exists, which deadline applies to you, roughly what the process looks like from here, and whether it is worth running at all. If it is not, we say so.

Common questions

Questions people ask on the first call

How much does a car accident lawyer in Brisbane cost?

Nothing up front. We act on no win no fee, so our professional fees are only payable if your claim succeeds, and under Queensland's 50/50 rule the total legal costs and uplift we deduct can never be more than half of what you recover after refunds are paid.

How long do I have to lodge a CTP claim in Queensland?

A Notice of Accident Claim Form must reach the CTP insurer within nine months of the accident or of the first appearance of your symptoms, or within one month of the day you first instruct a lawyer about the claim, whichever comes first. Court proceedings must be started within three years of the accident.

Can I claim if the accident was partly my fault?

Usually yes. Queensland applies contributory negligence, which reduces your damages by your share of responsibility rather than cancelling the claim. Drivers found partly at fault still recover compensation, and we assess that split before you commit to anything.

Do I have to go to court?

Almost never. Queensland's Motor Accident Insurance Act requires a compulsory conference and exchange of final offers before anyone can start proceedings, and the large majority of CTP claims settle at or before that conference.

Who are you and how are you connected to WT Compensation Lawyers?

We are the car accident practice of WT Compensation Lawyers, a Queensland personal injury firm with offices at Level 54, 111 Eagle Street in Brisbane and Boland's Centre in Cairns. Same lawyers, same files, same trust account. Jonathan Wu and Sinaumea Taufao lead the firm and their names are on the door.
